  • PRIVACY POLICY

Pepco Holdings, Inc. (“PHI”) is firmly committed to ensuring your online privacy.  Accordingly, the following notice explains our online Privacy Policy and the choices you can make about the way your personal information is collected and used.  This notice is available on our Homepage and at every point where your personal information may be requested.  This Privacy Policy applies to PHI and its affiliates and subsidiaries, including but not limited to, Potomac Electric Power Company, Delmarva Power & Light Company, and Atlantic City Electric Company.  Accordingly, this notice applies to all information collected or submitted on pepcoholdings.com, pepco.com, delmarva.com, and atlanticcityelectric.com.  This Policy also applies to use of any PHI mobile application.  By using any of PHI’s websites or applications, you represent that you agree with this Privacy Policy and our Terms of Use.  If you have any questions or concerns regarding this Privacy Policy, please Contact Us.

    THE INFORMATION WE COLLECT

We obtain information when you interact with us, when you use our products and services, and when you visit our websites.  PHI does not collect Personally Identifiable Information (“PII”) about you through our websites unless you voluntarily provide it.  PII is information that can be used to identify you as an individual.  Examples of PII which you may provide to us while using our websites include:

    • Name
    • E-mail address
    • Mailing address
    • Phone number
    • Account number
    • Social Security Number
    • Driver’s License Number
    • Information about your computer or browser
    • E-billing information that is linked to you via your password
    • Gender or ethnicity

We may collect PII when you create or modify your online account, respond to surveys, contact us via the Web, or complete any self-service transaction with us online.  At any time before you submit, you may opt-out of providing such information by either not providing it or by closing PHI’s websites.

Because protecting the privacy of website visitors, including our customers, shareholders, employees, and potential employees, is important to us, PHI does not sell, trade, rent, give, or distribute information about you or your account to any third party without your consent.  Furthermore, PHI will never e-mail you or initiate a phone call to request your account number, account ID, account password, Social Security Number, or banking information.

In general, when you visit a PHI website to read or download information, we do not collect your PII; we collect and store only the following generic information about your visit:

    • The name of the domain from which you access the internet (for example, aol.com if you are connecting from an America Online account)

THE WAY WE USE YOUR INFORMATION

PHI shares customer information within our family of companies for operational purposes.  We use the PII you provide to:

    • Answer your questions, fulfill your requests, and provide more complete service
    • Help you quickly find and receive information about PHI

    • Administer surveys
    • Protect the security and integrity of our websites

Except in certain circumstances explained in our Privacy Policy, we do not share PII with outside parties without your consent.

PHI also uses non‑identifying and aggregate information about website visitors to measure the number of visitors to the different sections of our site, and to help us make our websites more useful to visitors.  PHI reserves the right to share any aggregate and statistical information (non‑PII) with any third parties for any reason.  We use return email addresses to answer any email we receive, and such addresses are not shared with outside parties without your permission.  We never use or share the PII provided to us online in ways unrelated to the ways described above without also providing you an opportunity to opt‑out or otherwise prohibit such unrelated uses.

Absent your consent however, PHI may share PII you provide to us for legitimate business purposes, including the following:

    • Transferring information to PHI’s affiliates and subsidiaries
    • Transferring information as part of a merger, consolidation, acquisition, divestiture, or other corporate restructuring
    • Making the information available to third parties who are providing the products, services, or information you requested
    • Making information available to third parties who are service providers to PHI or its affiliates and subsidiaries (for example, computer-related services, credit card processing, e-mail service providers, map service providers, credit reporting agencies, and electronic bill payment services).  These companies are only authorized to use your PII as is required to provide these services to us
    • Disclosing information as is necessary to investigate, prevent, or take action regarding any illegal activities or interference with the operation of our websites or their Terms of Use
    • Disclosing information as is required by any federal or state law, subpoena or court order, or as we believe, in good faith, is necessary

We will retain your information for as long as your account is active, as needed to provide you with services, and as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. If you wish to cancel your account, or request that we no longer use your information to provide you with services, please review the “Access” section below.

    CONSENT

By using a PHI website or mobile application, you expressly consent to this Privacy Policy.  We may also supplement the information you provide to us with additional information we receive from a credit check performed when you apply for certain services.

Users of this website acknowledge and agree that their account(s) may be monitored and that customer account and other information which they provide through this website may be disclosed to the U.S. Government to protect PHI's network from unauthorized usage or penetration.

    OUR COMMITMENT TO DATA SECURITY

While no security system is absolutely safe, PHI uses industry-standard best practices to protect your PII from loss, misuse, alteration, and destruction.  To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, we have put in place appropriate physical, electronic, and managerial procedures to safeguard and secure the information we collect online.  In some areas of our websites, we require a user ID and password for you to access certain information.  PHI will never disclose passwords to third parties.  However, you are ultimately responsible for maintaining the privacy and security of your password, account number, and e-mail address.

    GENERAL

These Terms represent the complete agreement between the parties and supersede all prior agreements and representations between them.  Headings used in these Terms are for reference purposes only and in no way define or limit the scope of the section.  If any provision of these Terms is held to be unenforceable for any reason, such provision shall be reformed only to the extent necessary to make it enforceable and the other provisions of these Terms shall remain in full force and effect.  PHI’s failure to act with respect to a breach of these Terms does not constitute a waiver and shall not limit PHI’s rights with respect to such breach or any subsequent breaches.  These Terms shall be governed by and construed under Delaware law without regard to conflicts of law provisions.  Any action or proceeding arising out of or related to these Terms or your use of PHI’s websites must be brought in the state or federal courts of Delaware and you consent to the exclusive personal jurisdiction of such courts.
